The Reserve Bank of India issued final directions on 6 August 2026 setting conduct standards for loan recovery. They take effect on 1 January 2027. Earlier drafts proposed 1 July and 1 October 2026 dates; those have been superseded by the final text.

Who is covered

The directions apply to commercial banks, small finance banks, regional rural banks, local area banks and urban co-operative banks. Reports on the final framework indicate that NBFCs and housing finance companies are covered under corresponding rules; check your own lender's notice.

Key provisions

  • A written, board-approved recovery policy.
  • Recovery agents to hold IIBF certification, with a one-year window for existing agents.
  • Recording of recovery calls.
  • Disclosure of empanelled recovery agencies.
  • Civil, non-coercive conduct, with calling within permitted hours (RBI's earlier instructions prescribe 8 am to 7 pm).
  • Limits on locking of financed phones and devices.
  • A defined grievance redressal process.

What it means for a home loan borrower

If you fall behind on an EMI, you have a right to be treated with courtesy, to know who is contacting you on the lender's behalf, and to complain if a recovery agent behaves improperly. For secured loans, formal recovery follows the legal process, such as notices under the SARFAESI Act, not informal pressure.

If you are struggling to pay

  1. Contact the lender before you miss a payment and ask about restructuring, a tenure extension or a moratorium, if available.
  2. Keep all communication in writing and note call dates and times.
  3. Ask for the identity and authorisation of anyone who contacts you.
  4. Escalate unresolved complaints to the lender's nodal officer, then to the RBI Integrated Ombudsman if there is no response within 30 days.

Reminder: these rules protect conduct; they do not remove the obligation to repay. Missed payments still affect your credit score.
